Definitions

Graphics - refers to all free and paid artwork and illustrations created by Meeshmallow Studio, including, but not limited to, clip art, borders, frames, digital papers, color-by-code, backgrounds, scenes, spinners, directed drawings, and other similar digital elements.

Small Business - refers to an independent creator, teacher, or small-scale shop owner who sells handmade, digital, printable, or educational products in low to moderate quantities, such as through Teachers Pay Teachers, Etsy, or their own website, typically earning under $200,000 USD annually.

Moveable Ready Graphics Set - select clipart sets specifically created and formatted at 175 DPI for movable or digital use, ready to drop into any platform with no reformatting required. Labeled as such in the product title or description.

Copyright

All graphics created by Meeshmallow Studio are protected under international copyright law and the Digital Millennium Copyright Act (DMCA). Purchasing or downloading any graphics from Meeshmallow Studio grants you a non-transferable Standard License to use them according to these Terms of Use. Ownership of all artwork remains with Meeshmallow Studio, and all rights are reserved. It is strictly prohibited to trade, sell, share, or redistribute the graphics or files in any form. These terms apply to both new and previously purchased graphics.

License Overview

• This is a single-user, non-transferable Standard License attached to the purchase of any Meeshmallow Studio graphics.
• Graphics and graphic files may not be copied, resold, shared, or distributed in any way.
• Graphics may be used for both personal and small-business commercial projects, as long as commercial use follows all of the commercial use terms, which include the Permitted vs. Not Permitted sections on this page.
• Meeshmallow Studio cannot be held responsible for technical problems, file errors, or device damage that may occur when downloading or using digital files. By opening and using these files, you acknowledge that you are doing so at your own discretion.
• Because all products are delivered digitally, purchases are final and non-refundable. If you ever experience an issue with a file or download, please email meesh@meeshmallowstudio.com for help.
• Graphics may not be altered, recolored, cropped, or modified in any way. However, you may layer or combine them with other design elements, such as text, shapes, or backgrounds, when creating educational or creative projects with a clear purpose.
• Graphics may not be used in any offensive, discriminatory, or derogatory context, including content that targets individuals or groups based on race, religion, gender, orientation, or any other personal identity. You agree to indemnify and hold us harmless from any claims that arise from the misuse of the graphics.
• Graphics used in your products, free or for sale, must be securely flattened, such as PDF or JPEG, so they cannot be copied, extracted, or reused by others.

Personal Use Terms

• You can use the graphics for personal classroom activities, home projects, or decoration.
• You can use the graphics on your personal websites, blogs, store banners, logos, or social media if:
  • Your business does not sell clip art or digital graphics.
  • The graphics are part of a bigger design and not by themselves. No standalone images.
  • You give credit on websites and blogs with a link back to Meeshmallow Studio's TpT store or website.
  • Including the logo button is optional but greatly appreciated.
• You cannot sell, free or paid, or market things made with these graphics unless you follow commercial terms.

Commercial Use Terms Overview

• Credit is required for all commercial products, free or paid, under this Standard License, requiring the phrase "Graphics by Meeshmallow Studio" with a link to my TpT store or website, clearly displayed on your credits page or video description, including the logo button.
• You can sell or offer unlimited digital or printable products using the graphics on platforms like TpT, Etsy, Boom Learning, etc., provided you adhere to these Terms of Use.
• Products created with graphics cannot be sold as printed or physical items.
• Graphics must be securely flattened, such as PDF or JPEG, to prevent copying, extraction, or reuse.
• Commercial products must include your own text or content; graphics cannot be sold alone in any way.

Commercial Use - Permitted

• Use graphics in unlimited printable and digital products for free or for sale.
• Layer graphics with text, shapes, or backgrounds to create activities or products.
• Include graphics in previews, thumbnails, or promotional images if watermarked or flattened.
• Use graphics in course materials, tutorials, or guides, ensuring the graphics are not redistributed as standalone files.

• Sell or offer for free printable products, such as worksheets, planners, checklists, task cards, activities, flashcards, certificates, journaling pages, planner inserts, etc., with graphics.
• Coloring activities can be created with graphics. This is not the same as coloring pages. Coloring pages without text or content is considered stealing my work and selling it as your own. See the Not Permitted section.
• Create color-by-code activities with the color-by-code sets, but they must include content.
• Design printable educational or classroom bulletin board materials, like labels, headers, word walls, instructional signs, or displays, that serve a functional or instructional purpose, not just decoration.

• Sell or offer for free digital activities, like Boom Cards, Google Slides, Seesaw, or PowerPoint, with graphics, as long as they are flattened, such as PDF or JPEG, and inserted as a background image.
• Moveable pieces are only permitted on secured platforms: Boom Cards, TpT Easel, and Seesaw with a visible background, pattern, or text, without an extended license.
• Exception: Moveable Ready Graphics Sets can be used as moveable pieces on any platform, including Google Slides, PowerPoint, and Keynote, with no extended license or reformatting needed.
• Use graphics in educational or course videos, presentations, and livestreams if they support the content and are secured with backgrounds or text.
• Graphics can be included in planners and templates if flattened, embedded, and non-editable, and must be part of a larger design without individual extraction.

Commercial Use - Not Permitted

These apply to all commercial use. You cannot create, sell, for free or for profit, or do any of the following:

• Physical goods or print-on-demand (POD) products, including but not limited to apparel, stationery, mugs, posters, stamps, home decor, classroom decor, wall art, or stickers.
• Physical books or workbooks sold through Amazon KDP under this license.
• Physical, printable, or digital products where the graphics are the primary design element, including decor, wall art, coloring pages, stationery, cards, stickers, digital stickers, or similar items.
• Editable templates or designs that allow customers to customize, move, or replace the graphics. This includes, but is not limited to, platforms such as Canva, Templett, or Corjl.
• Products that have moveable pieces on unsecured platforms like PowerPoint or Google Slides. Exception: Moveable Ready Graphics Sets are licensed for use on all platforms under this Standard License.
• Selling or sharing designs for customer customization where graphics can be adjusted or replaced.
• Stickers or digital stickers of any kind, including printable sticker sheets, cut files, digital sticker packs, or similar products.
• Converting graphics into digital stamps, outlines, or black and white line art for crafting, coloring, or stamping products.
• Creating new clipart, digital papers, digital stickers, or similar art products using the graphics, whether used individually or combined.
• Altering, recoloring, cropping, or modifying graphics to create new artwork, clipart, or digital papers for resale.
• Uploading or converting graphics into reusable elements, including shapes, brushes, stamps, SVGs, laser or cut files, or embroidery files.
• Uploading graphics to platform asset libraries, such as Canva elements or marketplace clip banks, where others can access and use them.
• Creating coloring pages or "just for coloring" activities without meaningful text or content, and should not be marketed as such.
• Using graphics in apps, software, or digital tools under this license.
• Using graphics to train AI models, generate AI images, or include them in datasets or scraping pipelines.
• Using graphics in logos, branding, or marketing for businesses, including website or blog templates not owned by you.
• Registering trademarks that include graphics without written permission by Meeshmallow Studio.

Additional Information

By purchasing, downloading for free, or using any graphics from Meeshmallow Studio, you agree to follow these terms and use the graphics as outlined in this license.
